I. General Rules for Using the Website and App

1. Introduction

  1. Before accessing or using the website liffoweb.liffo.com ("Website") or the Liffo® mobile application ("Application") or the Liffo® application installed on the Liffo robot ("Liffo"), please read these terms of use carefully. These regulations are available on the Website, Application, and Liffo, as well as through third-party platforms ("Store").
  2. By using any service offered by the Website, Liffo, or the Application, the user fully accepts all the conditions described herein.

2. Use of Content

  1. The Website, Liffo, and the Application are the property of Robomagister srl ("Robomagister"). All material present is intended exclusively for private use: it is not permitted to copy, reproduce, publish, transmit, or disseminate the content in any way on other websites, applications, or media. Any commercial exploitation or any other use that Robomagister, at its sole discretion, deems unlawful or harmful is also prohibited.
  2. Any unauthorized reproduction or use, even partial, of texts, images, or other elements constitutes a violation of intellectual property rights and will be legally prosecuted.
  3. By accessing the Website or installing the Application, the user implicitly declares to have read, understood, and accepted these conditions, which include both the rules of use and those of sale, and to comply with all applicable regulations. If all conditions are not accepted, the use of the Website and the Application must be discontinued.
  4. The Website and the Application contain information protected by copyright and other property rules, which must be respected. The information published may contain errors or inaccuracies, for which Robomagister cannot be held responsible.
  5. Such information may be updated or modified at any time and without notice. Robomagister reserves the right to change, update, delete, or improve products, services, content, and features at any time, without obligations to the user. The use of information is at the sole risk of the user and does not imply the granting of licenses for copyright, patents, or other intellectual property rights.
  6. The published information may also refer to products not yet announced or not available in the user's country.

3. Submission of Information and Materials

  1. Robomagister does not accept the submission of confidential or proprietary materials or information through the Website, Liffo, or the Application. Anything sent to Robomagister will be considered non-confidential. By submitting any material or information, the user grants Robomagister the unlimited and irrevocable right to use, reproduce, modify, display, perform, transmit, and distribute such content; furthermore, Robomagister is authorized to freely use ideas, concepts, know-how, or techniques submitted for any purpose. The user guarantees the legitimate ownership and lawfulness of everything submitted, ensuring that no third-party rights, image rights, copyright, or other rights are violated, and undertakes to indemnify Robomagister from any claims.
  2. The user's name will not be made public or associated with the submitted materials, unless explicitly authorized, prior notification, or legal obligation.
  3. Materials and information include, by way of example, texts, messages, ideas, images, photographs, videos, audiovisual works, biographical data of oneself or third parties, and similar content sent, published, uploaded, or distributed by the user through the Website, Liffo, or the Application. Such materials will be treated as non-confidential, and Robomagister assumes no obligation or responsibility for their receipt, management, or eventual non-receipt. The submission of unsolicited materials occurs knowingly, without any confidentiality agreement and without expectation of compensation, reviews, or other consideration.
  4. In the event that Robomagister explicitly requests the submission of materials through specific features (e.g., for contests, promotions, or other initiatives), such content will be treated according to the purposes indicated in the privacy policy, always available in the dedicated section of the Website and the Application. The submission of materials in these cases implies acceptance of the proposed processing.
  5. If the information or materials submitted contain personal data, the rules indicated in Robomagister's updated Privacy Policy, available via a dedicated link, apply.

4. Responsibility

  1. Robomagister is not responsible for the content of third-party websites or applications accessible via links from the Website or the Application, even if they bear the Robomagister logo. Such websites and apps are independent, and the presence of links does not imply any approval or assumption of responsibility. It is the user's responsibility to take all necessary precautions to protect their devices from viruses, malware, or other harmful elements.
  2. Robomagister will never be liable for direct, indirect, special, or consequential damages arising from the use of the Website, the Application, or linked websites/apps, including – without limitation – loss of profit, business interruption, loss of data or programs, even if informed of the possibility of such damages. All information is provided "as is."
  3. Robomagister offers no warranty, express or implied, on fitness for a particular purpose, merchantability, or non-infringement of rules of use.
  4. The terms of use may be updated or modified at any time and without notice. By continuing to use the Website or the Application, the user also accepts these changes. It is advisable to consult this page regularly.
  5. Robomagister undertakes to keep the Website, Liffo, and the Application operational but cannot guarantee continuous availability, especially if access depends on mobile networks not under its control.

5. User Account

  1. To use the services, it is necessary to create a free account. The data provided must be truthful, and the user also declares that (i) they are not located in a country subject to a US government embargo or that has been designated by the US government as a "terrorist-supporting" country; and (ii) they are not included in any US government list of prohibited or restricted parties. It is not permitted to use third-party data or offensive nicknames. The user is responsible for all activities carried out through their account, which may be canceled in case of improper use by themselves or others. It is recommended not to share the password.
  2. The terms of use and the privacy policy constitute a binding agreement between the user and Robomagister. The services are reserved for adults. Anyone who does not declare their age will be treated as a minor and will not be able to access restricted areas.
  3. Robomagister reserves the right to verify the user's age and, in case of failure to demonstrate the requirements, to block the account and delete personal data.
  4. Violation of the conditions may result in the suspension, cancellation, or blocking of the account.

6. License to Use

  1. By accepting these conditions, Robomagister grants a personal, non-exclusive, non-transferable, and revocable license for the use of the Website, Liffo, and the Application for exclusively personal and non-commercial purposes. Robomagister may modify, suspend, or discontinue the service at any time, without obligations to the user.
  2. The license granted to the user by Robomagister constitutes a direct relationship between Robomagister and the user, with respect to which the provider of multimedia services through which the license agreement is stipulated (such as Apple or Google) remains extraneous. Consequently, such providers are not required to provide the user with any warranty, maintenance, support, or to respond to the user, or to third parties, for any claims, including those arising from alleged infringement of intellectual property rights.
  3. Robomagister and the user acknowledge that the multimedia service providers referred to in the previous paragraph are considered third-party beneficiaries of this license agreement and that, once the relevant terms and conditions have been accepted by the user, the multimedia service providers will have the right (and will be deemed to have accepted such right) to enforce this agreement against the user, as a third-party beneficiary thereof.

7. Usage Costs and Third-Party Contractual Conditions

  1. The user undertakes to comply with the applicable third-party contractual conditions when using the Website or the Application and is responsible for internet connection costs and any expenses related to such use. Access is free, except for any specifically indicated paid services.
  2. If the user uses a device for which they are not the holder of the telephone contract, it is assumed that they have obtained the prior consent of the holder.

8. Intellectual Property

  1. All content present (software, texts, images, audio, video, etc.) is the property of Robomagister or its licensors and protected by national and international laws. The user may not copy, distribute, modify, create derivative works, sell, or perform other unauthorized actions on the content. Any violation will be legally prosecuted.

9. Links to Third Parties

  1. Robomagister is not responsible for the content of third-party websites or applications accessible via links. The user accesses and uses such resources at their own risk and must adopt security measures against possible cyber threats.

10. Limitations of Warranty and Liability

  1. The use of the Website and the Application is at the sole risk of the user. The services are provided "as is," without express or implied warranties. Robomagister does not guarantee quality, availability, or performance and is not liable for direct or indirect damages, including loss of data or profits.
  2. The only solution in case of disputes is to stop using the services and delete your account.

11. Indemnification

  1. The user undertakes to defend and indemnify Robomagister, its licensors, and affiliates from any liability, claim, or expense arising from violations of the conditions or improper use of the account.

12. General Clauses

  1. If any part of the conditions is found to be invalid, the remaining parts remain effective. Failure to exercise a right does not constitute a waiver.

13. Applicable Law and Competent Court

  1. The contract is governed by Italian law, without prejudice to any mandatory rules of the user's country of residence. In case of disputes, the competent court is that of the consumer's residence or domicile.

14. Privacy

  1. Regarding the processing of personal data, reference is always made to Robomagister's updated privacy policy, available via a dedicated link.

II. Sales Rules via Website and Application

1. Introduction

  1. Before purchasing products through the Website, Liffo, or Application, it is necessary to carefully read these sales conditions, which form an integral part of the rules of use.

2. Object

  1. Sales contracts concern all products offered by Robomagister through electronic channels and are governed exclusively by these conditions.

3. Recipients

  1. Only individual consumers, acting for purposes unrelated to business or professional activities, can purchase. Minors under 18 cannot make purchases.

4. Purchase Procedure

  1. The purchase takes place at the price indicated at the time of order confirmation, with a summary of the unit price before sending.

5. Payments

  1. Payment by credit card can only be made by the cardholder. Data is managed through a secure system, without Robomagister becoming aware of or storing card data. Robomagister is not responsible for any unlawful use of cards.

6. Order Management

  1. After payment, Robomagister will verify the requests received. If customization of the material is possible, it is specified that any content uploaded by the user for this purpose will be evaluated in advance.
  2. Customization orders with the submission of offensive, violent, political, pornographic, alcohol or drug-related materials, or those that violate third-party rights, will not be processed and will be refunded. The user is responsible for the lawfulness of the submitted materials and undertakes to indemnify Robomagister from any third-party claims. Robomagister may request the replacement of unsuitable content before proceeding with order fulfillment.

7. Delivery

  1. Products are delivered to the address indicated by the user via courier or postal service, within 30 working days of payment. In case of payment by bank transfer, the 30 days start from the receipt of payment. If the product is not available, the user will be informed via email and can choose whether to wait, cancel the order, or receive a refund. Delivery takes place according to the "Delivered At Place" (DAP) formula: any duties and customs fees are borne by the buyer.

8. Warranty and Defective Products

  1. Products comply with online descriptions and are covered by the legal warranty provided by European directives. In case of conformity defects manifested within two years of delivery, the user can request restoration, replacement, or refund. The warranty does not apply if the defect was known or could not have been ignored at the time of purchase, or if the product was used incorrectly.

9. Right of Withdrawal

  1. If the Customer is a consumer, pursuant to the Consumer Code, they have thirty (30) days to withdraw from the contract, without having to provide any reason. This period starts from the date on which the Customer, or a third party other than the carrier and designated by the consumer, acquires physical possession of the goods or, in the case of multiple goods ordered by the consumer with a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good. The Customer may exercise the right of withdrawal by sending Robomagister a written communication, or an e-mail to support@liffo.com. The Customer must then, at their own care and expense, return the purchased Products to Robomagister, including accessories and any promotional gifts, within the original packaging and packing, no later than fourteen (14) days from sending the withdrawal communication. Upon receipt of the returned Products, Robomagister will, without undue delay, re-credit the Customer all sums received in payment, using the same means of payment used by the Customer for the initial transaction, unless otherwise expressly instructed by the Customer, without any charge or penalty. Robomagister may refuse the return if the Products are returned clearly damaged. In any case, the Customer will be responsible for the decrease in the value of the goods resulting from handling them other than what is necessary to establish the nature, characteristics, and functioning of the goods, or caused by their use not in accordance with the instructions contained in the user manual provided by Robomagister.
  2. In case of exercise of the right of withdrawal, the Customer must refrain from using the digital content and services necessary for the functioning of the Products, as well as from making them available to third parties.
