Trade-in Regulation
Preamble
This Regulation (the "Regulation") governs the operational procedures through which Robomagister S.r.l. (hereinafter "Robomagister") allows the Customer to purchase the Liffo product by transferring, as partial compensation for the price, their own used appliance of the food processor category (the "Transferred Robot"), as provided in the "Trade-in Purchase" paragraph of the General Conditions of Sale.
The Regulation forms an integral part of the General Conditions of Sale for Customers who choose this purchase method. In case of conflict, the General Conditions of Sale prevail.
1. Definitions
- Customer: the adult natural person acting for purposes outside any business, commercial, craft or professional activity, pursuant to the Consumer Code.
- Liffo: the main product being purchased.
- Transferred Robot: the used appliance of the food processor category (Bimby, KitchenAid, Kenwood, Moulinex, Magimix, Tefal, Cuisinart, Bosch, Silvercrest or other brands accepted by Robomagister), which the Customer transfers as partial compensation for the price of Liffo.
- Preliminary Trade-in Value: the amount in Euros that a Robomagister consultant communicates to the Customer at the end of the assessment, calculated on the basis of the information, declarations and photographs provided by the Customer, including through interaction with the automated assistance system.
- Automated Assistance System: the conversational tool (bot) that, after submission of the initial form, collects from the Customer the additional information and photographs necessary to complete the assessment. It is used for exclusively internal purposes to support the preliminary valuation; the contact and commercial proposal to the Customer are always conveyed by a human consultant.
- Payment-in-Kind: the delivery of the Transferred Robot to Robomagister, which serves as partial consideration for the price of Liffo, for an amount equal to the Confirmed Trade-in Value. In the trade-in purchase mode it replaces the confirming earnest money in cash provided for standard orders.
- Confirmed Trade-in Value: the amount in Euros that Robomagister confirms to the Customer within 5 business days from receipt of the Transferred Robot at its premises, following physical verification.
- Order Proposal: the commercial document sent to the Customer within 24 hours from completion of the assessment, containing the price of Liffo, the Preliminary Trade-in Value and the final discounted price.
- Trade-in Verification Report: the internal document by which Robomagister certifies the conditions found on the Transferred Robot upon receipt and formalizes the Confirmed Trade-in Value.
- Addendum to the Order Proposal: the document signed by the Customer in case of value recalibration, by which the Customer accepts the Confirmed Trade-in Value modified from the preliminary one.
- Lump-sum Penalty: the amount of € 100 owed to Robomagister by the Customer in case of failure to deliver the Transferred Robot to the appointed courier, pursuant to the "Trade-in Purchase" paragraph of the General Conditions of Sale.
2. Accepted brands and models
Robomagister accepts for trade-in food processors, multicookers and stand mixers from all major brands present on the European market, including (non-exhaustive list): Vorwerk Bimby (models TM21, TM31, TM5, TM6, TM7), KitchenAid, Kenwood (Cooking Chef, Chef Sense), Moulinex (Cuisine Companion, i-Companion), Magimix Cook Expert, Tefal Cuisine Companion, Cuisinart, Bosch Cookit, Silvercrest Monsieur Cuisine, and similar.
Robomagister reserves the right not to accept for trade-in appliances:
- clearly not corresponding to the food processor category;
- severely damaged or unusable even as spare parts;
- originating from theft or of illegitimate provenance;
- presenting biological or chemical contamination or other conditions preventing safe transport under applicable regulations.
3. Trade-in procedure
Phase 1 — Valuation request (initial form)
The Customer completes the valuation request form published on the Website, indicating in particular:
- brand and model of the Transferred Robot;
- year of purchase (even estimated);
- declared state of preservation (perfect, good, signs of use, damaged);
- included accessories (jugs, blades, containers, recipe books, cables, supports);
- any known malfunctions.
The Customer may optionally upload first photographs of the Transferred Robot at this stage.
Phase 1-bis — Assessment completion via Automated Assistance System
Following the submission of the initial form, the Customer is invited to interact with Robomagister's Automated Assistance System (conversational bot). The system may ask the Customer to:
- upload photographs of the Transferred Robot (front, back, any defects, accessories);
- provide additional information about model, conditions of use, accessories, malfunctions;
- confirm some data already provided in the initial form.
The assessment is deemed complete when the system has all the information necessary to formulate the preliminary valuation. The Customer is informed that the outcome of the assessment is also processed with automated tools for exclusively internal use: such processing does not constitute automated decision-making producing legal effects for the Customer under art. 22 of EU Regulation 2016/679 (GDPR), since the final commercial proposal is always formulated and conveyed by a human consultant (see Phase 2).
If the Customer does not complete the assessment within 7 days from submission of the initial form, the request will be deemed not perfected and may be restarted by the Customer at any time by resubmitting the initial form.
Phase 2 — Consultant contact and Order Proposal within 24 business hours
Within 24 (twenty-four) business hours from completion of the assessment under Phase 1-bis, a Robomagister consultant contacts the Customer (by phone and email, according to the contact details provided) to present and formalize the Order Proposal containing:
- list price of Liffo in the chosen configuration;
- Preliminary Trade-in Value, expressed in Euros, calculated on the basis of the information collected in Phase 1 and Phase 1-bis;
- final price of Liffo, reduced by the Preliminary Trade-in Value;
- validity period of the Order Proposal (typically 15 days from the date of issue);
- full clause subordinating the Preliminary Trade-in Value to physical verification;
- reference to the lump-sum penalty of € 100 for failure to deliver the Transferred Robot.
In the trade-in purchase mode no earnest money in cash is required: the Transferred Robot serves as Payment-in-Kind on the price of Liffo.
Assessments completed during the weekend or on holidays give rise to contact within the first following business day. The Order Proposal is also sent to the Customer in writing by email at the end of the conversation with the consultant.
Phase 3 — Customer acceptance
The Customer who intends to proceed with the purchase signs the Order Proposal. Signing perfects the sales contract and produces the following effects:
- the Customer irrevocably commits to deliver the Transferred Robot to the courier appointed by Robomagister, at the address indicated in the Proposal;
- the Transferred Robot serves as Payment-in-Kind on the price of Liffo, for an amount equal to the Confirmed Trade-in Value following physical verification;
- the Customer expressly accepts the clause on the preliminary nature of the Trade-in Value and its subordination to physical verification;
- the Customer expressly accepts the lump-sum penalty of € 100 provided in case of failure to deliver the Transferred Robot to the courier, pursuant to the "Trade-in Purchase" paragraph of the General Conditions of Sale;
- Robomagister is authorized to organize the free collection of the Transferred Robot.
No earnest money in cash is due.
Phase 4 — Free collection of the Transferred Robot
Robomagister, through an appointed courier, contacts the Customer within 1-2 business days from signing the Order Proposal to arrange the date and time slot for collection. Collection takes place at no cost to the Customer.
At the time of collection, the Customer delivers to the courier the Transferred Robot complete with all accessories declared in the valuation form, ideally in its original packaging or, failing that, in packaging suitable to ensure safe transport. Robomagister may provide operational instructions or, upon request, a packaging kit.
The courier issues a collection receipt, which evidences delivery but not the verification of conditions.
If the Customer is absent at the first collection attempt, the courier will leave a notice and contacts to arrange a second attempt, to be carried out within 7 (seven) days. The provisions of Phase 4-bis apply.
Phase 4-bis — Failure to deliver the Transferred Robot at collection
Should the Customer, at the first collection attempt scheduled by the courier, fail to make the Transferred Robot available (due to absence, change of mind or any other cause), the courier will leave a notice and propose a second attempt within 7 (seven) days. After 15 (fifteen) days from the first attempt without collection being completed for a cause attributable to the Customer, the order will be deemed terminated due to the Customer's fault and Robomagister will apply the lump-sum penalty of € 100 provided by the "Trade-in Purchase" paragraph of the General Conditions of Sale.
The penalty is charged through a payment request to be honored within 14 (fourteen) days of communication. In case of non-payment, Robomagister may activate ordinary credit recovery procedures.
The provisions of this Phase do not apply where the failure to deliver is attributable to force majeure causes documented by the Customer (for example: illness, bereavement, disasters). In such cases, upon timely communication by the Customer to support@liffo.com, Robomagister will evaluate case by case the rescheduling of collection or, where the Customer so requests, the consensual termination of the order without penalty.
Phase 5 — On-site verification within 5 business days
Within 5 (five) business days from receipt of the Transferred Robot at its premises, Robomagister carries out a technical verification including:
- visual check of the state of preservation, accessories, completeness;
- basic functional test (power, motor, controls, display if any);
- photographic documentation of the conditions found;
- drafting of the internal Trade-in Verification Report.
At the end, Robomagister communicates to the Customer, by email, the outcome of the verification:
Case A — Valuation confirmed
The conditions found correspond to those declared by the Customer. The Preliminary Trade-in Value is confirmed and becomes final. Robomagister simultaneously sends the Customer the confirmation and the indication of the balance to be paid to proceed with the shipment of Liffo.
Case B — Valuation recalibrated
The conditions found differ from those declared (for example: undeclared malfunctions, missing accessories, damage greater than reported). Robomagister proposes to the Customer a Recalibrated Trade-in Value, justified and accompanied by photographs. The Customer has 7 (seven) days from the communication to:
- accept the new value by signing the Addendum to the Order Proposal: the balance reduced by the new Trade-in Value is processed and Liffo is then shipped;
- refuse the new value by communicating it by email to support@liffo.com: the order is terminated and the Transferred Robot is returned to the Customer within 14 days from the refusal communication, to the original collection address and at no cost to the Customer. No penalty is due in this case, since the refusal is exercise of a contractual right.
In absence of a reply within the 7-day period, the procedure follows as in the case of refusal.
Case C — Robot not acceptable
If the Transferred Robot falls within one of the cases of non-acceptance under article 2 of this Regulation, the order is terminated and the same procedures as Case B apply (robot returned free of charge, no penalty due).
Phase 6 — Balance and shipment
Once the Trade-in Value is confirmed (Case A or Case B with acceptance), the Customer pays the balance of the price (Liffo − Confirmed Trade-in Value) using one of the payment methods provided by the General Conditions of Sale.
Upon successful payment, Robomagister issues an invoice and proceeds with the shipment of Liffo as provided by the General Conditions of Sale.
4. Right of withdrawal
The Customer who has purchased Liffo with the trade-in method benefits from the same 30 (thirty) day right of withdrawal provided by the General Conditions of Sale.
In case of exercise of withdrawal, Robomagister:
- refunds to the Customer, within 14 (fourteen) days from receipt of returned Liffo, the monetary amount actually paid in cash by the Customer (namely, the balance of the price net of the Confirmed Trade-in Value);
- also refunds to the Customer, in the form of an equivalent monetary amount, a sum equal to the Confirmed Trade-in Value (as reimbursement of the Payment-in-Kind), by re-crediting to the same payment method used for the initial transaction, unless otherwise instructed by the Customer.
The Customer acknowledges and accepts that, once the valuation under Phase 5 has been confirmed, the Transferred Robot remains in the full availability of Robomagister, which may freely dispose of it (resale as used, refurbishment, disposal) even before the expiry of the withdrawal period. Consequently, the refund of the Payment-in-Kind in case of withdrawal occurs exclusively in monetary form and does not entail the physical return of the Transferred Robot.
In line with the General Conditions of Sale, the Customer exercising withdrawal must return Liffo, at their own expense, in the original packaging, within 14 days from the withdrawal communication.
5. Withdrawal before delivery of Liffo
The Customer may also, before delivery of Liffo, freely withdraw from the purchase. Three scenarios are distinguished:
- Before collection of the Transferred Robot: the order is cancelled at no cost. The provisions of Phase 4-bis remain applicable should the withdrawal intervene after the courier has organized the first collection attempt.
- After collection of the Transferred Robot but before completion of verification (Phase 5): the order is cancelled and the Transferred Robot is returned to the Customer, free of charge, within 14 days from the withdrawal communication. No penalty is due.
- After confirmation of the Trade-in Value but before shipment of Liffo: the order is cancelled and Robomagister refunds to the Customer, as reimbursement of the Payment-in-Kind, a monetary amount equal to the Confirmed Trade-in Value, within 14 days from the withdrawal communication. The Transferred Robot remains in Robomagister's availability.
6. Legal warranty
The provisions on legal warranty of conformity set out in the General Conditions of Sale apply to Liffo purchased through trade-in in their entirety, without any limitation linked to the trade-in mechanism. The Confirmed Trade-in Value does not affect the terms or the subject of the warranty, which remain referred to the list price of Liffo.
7. Privacy and data processing
The processing of the Customer's personal data within the trade-in procedure takes place according to the Privacy Policy published on the Website. In particular, the data provided through the valuation request form and during interaction with the Automated Assistance System (including brand and model of the Transferred Robot, photographs, usage information) are processed for the purpose of contract execution and, subject to the Customer's optional consent, for marketing purposes.
In accordance with articles 13 and 22 of EU Regulation 2016/679 (GDPR), the Customer is informed that the preliminary valuation assessment may be supported by automated processing tools, for exclusively internal use by Robomagister. Such tools do not produce direct legal effects for the Customer, since the final commercial proposal is always formulated, verified and conveyed by a human consultant. The Customer is in any case entitled to request human intervention at any stage of the assessment, by writing to support@liffo.com.
8. Updates to the Regulation
Robomagister reserves the right to update this Regulation by giving timely notice through publication on the Website. The amendments apply to Order Proposals accepted after the date of publication.
