B) תנאי מכירה כלליים

General Conditions of Sale. The following General Conditions of Sale contain the terms and conditions that govern, in accordance with the provisions of articles 45 et seq. of D.Lgs. 6 September 2005, n. 206 (the Consumer Code) the sale, or pre-orders, of products and services (the Products) marketed by Robomagister S.r.l., with registered offices at 42124 Reggio Emilia (RE) via Carlo Calvi di Coenzo 8, Tax Code and VAT No. 02973970359 (Robomagister) through the website www.liffo.com (the Website) or, through the intermediary of appointed agents, on the occasion of promotional and/or demonstration events in the territory.

All Customers are invited to carefully read these General Conditions of Sale before making any purchase, possibly printing a copy from the Website for future reference. Every Customer will be asked to accept the following General Conditions of Sale before placing an order in any manner: failure to accept will prevent the Customer from completing the order.

The following General Conditions of Sale were prepared on March 20, 2025 and last updated on May 19, 2026; Robomagister reserves the right to update, integrate and/or modify the General Conditions of Sale at any time, giving notice to all Customers by publication on the Website pages. All updates/modifications/integrations will be effective with respect to orders completed after their publication on the Website.

Update of May 19, 2026: introduction of the "Trade-in Purchase" paragraph, introduction of payment-in-kind and of the lump-sum penalty for failure to deliver the Transferred Robot, amendments to the "Perfection of Contract", "Right of Withdrawal" and "WEEE" paragraphs. These changes apply to orders completed from the publication date onwards.

Illustrative Material. Technical characteristics and information about the Products are contained on the Website as well as in the illustrative and promotional material made available on the occasion of demonstration events in the territory. All images of the Products and their respective packaging, whether on the Website or on another medium, have purely illustrative purposes: they may therefore differ from the actual appearance of the Product.

Personal Data. To place an order, you must be of legal age. Since completing the purchase and executing payment require communication to Robomagister of some personal data, the Customer must first review the privacy policy and give consent to the processing of their data, in accordance with current personal data protection legislation.

Perfection of Contract. The completion and submission of an order, made either through the Website or through an appointed consultant, represent an irrevocable offer to purchase by the Customer. The sales contract will be perfected at the moment when, after payment by the Customer, Robomagister sends the Customer an order confirmation by email, containing a summary of the purchase conditions and the link to these General Conditions of Sale.

Order with trade-in (payment-in-kind). Where the Customer chooses to purchase using the trade-in method referred to in the "Trade-in Purchase" paragraph, no confirming earnest money in cash applies: the Transferred Robot serves as payment-in-kind on the price of Liffo, for an amount equal to the Confirmed Trade-in Value following physical verification. Signing the Order Proposal in trade-in mode perfects the sales contract and irrevocably commits the Customer to delivering the Transferred Robot to the courier appointed by Robomagister, in accordance with the Trade-in Regulation published on the Website.

Product Pre-order. During the first sales campaign, the Customer may reserve the Products in order to take advantage of the first production slots. At the time of order, the Customer must pay Robomagister the deposit (including VAT) due as confirming earnest money: Robomagister will immediately confirm receipt of the pre-order. Subsequently, Robomagister will inform the Customer as soon as the Products are available for delivery. The Customer must then pay the remaining balance price within no more than 30 (thirty) days from receipt of the email confirming availability of the Products, simultaneously confirming the methods and address of shipment of the Products.

Until the deadline for payment of the balance price, the Customer remains free to cancel their pre-order, and, upon communication of cancellation, Robomagister will proceed to return what was received as confirming earnest money by re-crediting to the payment instrument used by the Customer for the initial transaction; conversely, if the Customer, having received confirmation of the availability of the Products, fails to pay the balance price within the 30 (thirty) day period indicated above, Robomagister will retain what was received as confirming earnest money, pursuant to art. 1385 c.c..

Prices. All prices are in Euro. The prices indicated on the Website or in the informational material are inclusive of VAT, if due under law, as well as any other tax, duty or contribution legally required in relation to the transaction. In particular, it is specified that VAT is also due for Products whose delivery will take place in Livigno or another free trade area: the Customer cannot, therefore, make any request for refund from Robomagister. If you meet the requirements of Law 104/1992 for the application of the reduced VAT rate, the Customer must contact Robomagister by writing to the email address support@liffo.com.

Robomagister may occasionally offer discounts or other promotional codes to be applied to certain purchases of Products. Furthermore, particular purchase conditions may be communicated and applied to certain categories of Customers. In any case, the discount applied will be detailed in the order summary, before it is actually submitted by the Customer or the appointed agent. The specific regulation of these promotional initiatives will be appropriately communicated by publication on the dedicated pages of the Website.

Shipping. Products will be shipped only to European countries. Unless otherwise indicated, product prices do not include transportation and delivery costs, which are the responsibility of the Customer. Before submitting the order, the Customer will obtain a summary of the total price due, including shipping costs; this summary will then be reported in the email message confirming receipt of the order itself.

Delivery Method. The ordered Products will be delivered to the Customer at the address specified by them at the time of order by a courier appointed by Robomagister. After delivery to the carrier, Robomagister will confirm shipment to the Customer by email, simultaneously communicating the data for tracking the shipment. If the recipient is absent, the courier will leave a notice indicating the methods to arrange with them a new delivery attempt.

If the Customer does not contact the courier within 14 (fourteen) days of the first delivery attempt, the courier will return the package to Robomagister, which will consider the sales contract resolved due to the Customer's fact and fault. Upon receipt of the returned package, Robomagister will return to the Customer the price paid by re-crediting to the payment instrument used for the initial transaction, retaining the amounts due to the carrier for storage and return of the package, but without any other charge for additional damage.

Upon receipt, the Customer – or their representative – is required to verify the conditions of the Product delivered to them. In case the packaging shows signs of tampering or alteration, the Customer – or their representative – must refuse delivery or, in case of acceptance, must verify that the courier notes the description of the defect found on the transport document; furthermore, the Customer must give prompt notice to Robomagister by sending an email to support@liffo.com, in order not to incur the forfeitures of which art. 1698 c.c..

Payment. Payment of the price must be made using one of the methods indicated on the Website or by the sales consultant appointed. No additional fees will be charged to the Customer due to the payment method chosen. Upon successful payment, Robomagister will issue an invoice to the Customer pursuant to law. The tax document will be transmitted in electronic format pursuant to law; the Customer will also be sent by email a courtesy copy of the same invoice, useful for the purpose of enjoying warranty assistance on the device, as mentioned in article 11 below.

Installment Payment via Financial Company: The Customer may choose to purchase the products/services offered on the Website through installment payment through Leasifin S.p.A.. In this case, the financing request will be subject to evaluation and possible approval by Leasifin, which will act as a third party and autonomous holder of the consumer credit contract. The financing contract shall be deemed perfected exclusively with the signing and approval by Leasifin; the Seller assumes no responsibility regarding the granting or refusal of financing. All legal and economic relationships relating to the financing (including charges, fees, interest, installments, economic and contractual conditions) are regulated exclusively by the contract entered into between the Customer and Leasifin.

Trade-in Purchase. Robomagister allows the Customer to purchase the Liffo Product by transferring, as partial consideration for the price, their own used appliance of the food processor category (the "Transferred Robot"), in accordance with the terms described in the Trade-in Regulation published on the Website at www.liffo.com/en/trade-in-regulation (the "Regulation"), which forms an integral part of these General Conditions of Sale for Customers who choose this purchase method.

In summary, the Customer intending to use the trade-in must: a) complete the valuation request form published on the Website, indicating brand, model and condition of the Transferred Robot; b) complete the assessment by interacting with the automated assistance system made available by Robomagister, which may request additional information and photographs necessary to refine the preliminary valuation; c) be contacted, within 24 (twenty-four) business hours from completion of the assessment, by a Robomagister consultant who will present the order proposal containing the preliminary trade-in value and the final Liffo price reduced by such value; d) accept the order proposal by signing it, thereby irrevocably committing to deliver the Transferred Robot to the courier appointed by Robomagister and authorizing the same to arrange the free collection at the communicated address. Signing the Order Proposal perfects the sales contract; the Transferred Robot serves as payment-in-kind on the price of Liffo, for an amount equal to the Confirmed Trade-in Value following the physical verification under this paragraph. No earnest money in cash is due.

The Customer acknowledges that, during the assessment phase, the preliminary valuation is processed by Robomagister also through automated tools for exclusively internal use; the order proposal is, in any case, conveyed and formalized by a Robomagister consultant.

The trade-in value indicated in the order proposal is preliminary in nature and subject to physical verification of the Transferred Robot upon receipt at Robomagister's premises. This verification will be completed within 5 (five) business days from receipt of the Transferred Robot; at the end, Robomagister will communicate to the Customer by email the confirmed trade-in value.

If the verification confirms the conditions declared by the Customer, the preliminary trade-in value becomes final and is deducted from the balance due.

If the verification reveals conditions different from those declared by the Customer (for example: malfunctions, damage, missing accessories, signs of use not reported), Robomagister will propose to the Customer a recalibrated trade-in value, justified and documented with photographs. The Customer may, within 7 (seven) days from communication: a) accept the new value by signing an addendum to the order proposal, in which case the balance reduced by the new trade-in value is processed and Liffo is shipped; b) refuse the new value, in which case the order will be terminated and the Transferred Robot will be returned to the Customer at no cost, to the address indicated for collection. In absence of a reply within the indicated period, the order will be deemed tacitly terminated according to option (b).

Penalty for failure to deliver the Transferred Robot. Should the Customer, after signing the Order Proposal, fail to make the Transferred Robot available at the first collection attempt or at subsequent attempts arranged with the courier, and in any case no later than 15 (fifteen) days from the first attempt, the order will be deemed terminated due to the Customer's fault. In such case, as a lump-sum coverage of the costs incurred by Robomagister (logistics, administrative handling, consultant's activity), a lump-sum penalty of € 100 is due to Robomagister, pursuant to art. 1382 c.c. This penalty is specifically approved by the Customer through the signing of the specific acceptance clause under art. 1341, second paragraph, c.c., included in the Order Form.

Robomagister acquires full ownership of the Transferred Robot at the time of payment of the balance, without prejudice to what is provided regarding the Right of Withdrawal.

Right of Withdrawal. If the Customer is a consumer, under the Consumer Code, they have thirty (30) days to withdraw from the contract without having to provide any reason. This period runs from the date on which the Customer, or a third party other than the carrier and designated by the consumer, acquires physical possession of the goods or, in case of multiple goods ordered by the consumer through a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good.

The Customer may exercise the right of withdrawal by sending a written communication to Robomagister using the withdrawal rights form available here or an email to support@liffo.com. The Customer must then return the purchased Products to Robomagister at their own expense, including accessories and any promotional gifts, in the original packaging and wrapping, within no more than fourteen (14) days from the sending of the withdrawal communication.

Upon receipt of the returned Products, Robomagister will promptly refund all amounts received in payment to the Customer using the same payment method used by the Customer for the initial transaction, unless otherwise expressly instructed by the Customer, without any charge or penalty. Robomagister may refuse the return if the Products are returned obviously damaged.

In any case, the Customer is responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods, or caused by use not in accordance with the instructions contained in the user manual supplied by Robomagister.

Withdrawal in case of trade-in purchase. Should the Customer have purchased the Product with the Trade-in Purchase method and exercise the right of withdrawal, Robomagister will refund in full the sums actually paid in cash by the Customer (namely, the balance of the price net of the Confirmed Trade-in Value) as well as, by way of reimbursement of the payment-in-kind, a sum of money equal to the Confirmed Trade-in Value, by re-crediting to the same payment method used by the Customer for the initial transaction, unless otherwise instructed by the Customer. The Transferred Robot remains in Robomagister's possession, subject to any different written agreement between the parties entered into prior to the withdrawal communication. The Customer acknowledges and accepts that the refund of the payment-in-kind occurs exclusively in monetary form, the physical return of the Transferred Robot not being due once the valuation has been confirmed.

In case of exercise of the right of withdrawal, the Customer must refrain from using the contents and digital services necessary for the operation of the Products and from making them available to third parties.

Warranty and Assistance. If the Customer is a consumer under the Consumer Code, they benefit from the warranty provided by articles 128 et seq. of the same Consumer Code. In particular, Robomagister is responsible to the Customer for any defect or non-conformity existing on the Products at the time of delivery of the good, provided it manifests within two (2) years from that date. The Customer must report in writing to Robomagister the discovery of the defect or non-conformity within the limitation period of twenty-six (26) months from delivery of the goods, attaching to the report a copy of the invoice issued by Robomagister at the time of purchase.

Verified the occurrence of the requirements, Robomagister will provide the customer with instructions for proper management of the assistance matter. In particular, in case of return, the Product will be subjected to all investigations necessary to verify the actual existence of the defect and its qualification as a non-conformity defect under law. In case the warranty is operative, the Customer will have the right to restore conformity or functionality of the Product through repair or replacement; if this is not possible, after timely communication by Robomagister, the Customer may obtain a corresponding price reduction or termination of the contract, pursuant to articles 135 bis et seq. of the Consumer Code.

Excluded from warranty are deteriorations suffered by individual components such as seals, lids, pot and jars, as well as mechanical parts such as motors. Furthermore, the Customer forfeits the warranty in case of tampering with, repair or maintenance of the device by third parties not authorized by Robomagister, in case of use of spare parts or accessories not original – if Robomagister proves the existence of a causal connection between the use of these or the intervention carried out and the defect found – or in case of use of the device with a voltage different from that prescribed or in a manner not in accordance with what is indicated in the product specifications and the user manual of the Product, as well as in case of incorrect assembly of accessories or spare parts, with the Customer retaining the possibility of providing proof to the contrary that the malfunction found is due to a defect of conformity of the product existing at the time of delivery.

The same warranty conditions apply to digital contents and services necessary for the use of the Products, provided the Customer has regularly performed the installation of the respective updates, in compliance with the notices received from Robomagister on the occasion of each periodic release.

In any case of malfunction of the Products, even at the end of the warranty period, the Customer may contact the assistance service at the following contacts: Email: support@liffo.com

Limitation of Liability. If the products are used in the context of the Customer's commercial and/or business activity, Robomagister will not be liable for any damages to the Customer caused by loss of profit or business opportunities or interruption of activity.

WEEE. D.Lgs 49/2014 on waste of electrical and electronic equipment (WEEE) provides that electrical appliances should not be disposed of in the normal flow of solid municipal waste. Discarded devices must be collected separately to optimize the recovery and recycling rate of the materials that compose them, achieve significant energy savings and prevent potential damage to human health and the environment. The crossed-out bin symbol is displayed on all products to remind of the obligations of separate collection.

The Customer may deliver the discarded electrical appliances to the public collection service, bring them to appropriate municipal areas or return them to retailers. All major appliance manufacturers are active in creating and managing collection and disposal systems for discarded devices.

In compliance with what is provided by art. 11, paragraph 1 of D.Lgs. 49/2014, at the time of supply of a new electrical or electronic device (defined as AEE) intended for a household, Robomagister ensures the free collection of the old electrical or electronic device (defined as WEEE) having the same functionality. In particular, the free collection of WEEE occurs on condition that it has been used in the household, is of equivalent type and has performed the same functions as the new electrical equipment purchased.

Since the courier appointed for delivery of the purchased Products is not enabled to transport WEEE, any collection of the latter will be ensured by Robomagister through subsequent taking over by a different courier, but in any case without costs to the Customer. In order to allow for timely organization of the collection of WEEE, the Customer must communicate this need at the latest, under penalty of forfeiture of the relative right, 24 hours before the scheduled date of delivery of the purchased products by email to support@liffo.com.

No free collection is provided for a purchase of items not belonging to the AEE category, the details of which are reported in annexes I and II of D.Lgs. 49/2014. Collection of WEEE that poses contamination or safety risks to transport personnel is not permitted.

Relationship between WEEE collection, Trade-in and Scrappage Discount. The Customer's right to free WEEE collection of equivalent type, provided by D.Lgs. 49/2014 and governed by the preceding paragraphs, is autonomous and distinct both from the Trade-in Purchase method and from any promotional commercial discounts offered by Robomagister (for example, the "Scrappage Discount"). Collection for trade-in purposes presupposes an economic valuation of the Transferred Robot and is governed by the Trade-in Regulation. The Scrappage Discount, where offered, constitutes a unilateral commercial initiative of Robomagister, not conditional on the transfer of a used item: in such case, the collection of the Customer's discarded appliance takes place free of charge under D.Lgs. 49/2014 without recognition of any separate economic value. The Customer who accesses the Trade-in cannot combine both forms of collection for the same appliance.

Force Majeure. In case of extraordinary and unforeseeable events, constituting force majeure or unforeseeable events, Robomagister will not be liable to the Customer for delayed or failed delivery of the Products and will be entitled to suspend or terminate the contract, in compliance with applicable law.

Intellectual Property. Intellectual and industrial property rights, such as for example copyrights, trademarks, patents and designs relating to the Products are held exclusively by Robomagister or its licensors and are protected pursuant to applicable law and international treaties on intellectual property. All trademarks – word or figurative – and any other distinctive sign, company name, service mark, illustration, image or logo in any way connected to the Products are and remain the exclusive property of Robomagister or its licensors and are protected pursuant to applicable law and international treaties on intellectual property.

Applicable Law and Jurisdiction. The present General Conditions of Sale and all contracts concluded between Robomagister and Customers are governed by Italian law; if the Customer has their habitual residence in another country of the European Union, the law in force in that country will apply. Any dispute arising from or relating to the interpretation, application or performance of these General Conditions of Sale and the contracts consequently entered into between the parties shall be exclusively within the jurisdiction of the court of the place of habitual residence of the consumer, as provided by art. 66 bis of the Consumer Code.

Contacts. For any need, the Customer may contact Robomagister S.r.l. through the following contact channels: by mail, at the address via Carlo Calvi di Coenzo 8, 42124 Reggio Emilia (RE); by email, at support@liffo.com. If Robomagister needs to contact the Customer in writing, it will send an email to the address communicated by the Customer.
